Brianna Zunino Denison, born March 29, 1988, was a graduate of Reno High School who was home in Reno, Nevada during a winter break from Santa Barbara City College, where she studied psychology. On January 20, 2008, at about 4 a.m. Pacific Time, she was last seen alive at a friend's house on Mackay Court near the University of Nevada, Reno campus, after attending a party at the Sands Regency. Her friend woke around 9 a.m. and could not find her. A small bloodstain, later confirmed to be Denison's, was found on the pillow she had used. Denison had left without her shoes, cell phone, or purse, and was believed to be wearing only sweats and a white tank top.
Reno Police conducted a forensic investigation of the residence and recovered touch DNA from an unidentified male on the doorknob. Investigators treated the case as a kidnapping and, alongside the FBI, began searching the University of Nevada, Reno area on January 21, 2008. The male DNA from the scene was linked to at least two prior sexually motivated attacks in the same area, on November 13, 2007, and December 16, 2007. A separate report emerged of an unreported rape at gunpoint in a campus parking garage in October 2007. Police interviewed close to 100 registered sex offenders living within a mile of the Mackay Court home. Approximately 1,700 volunteers, including then-Nevada First Lady Dawn Gibbons, took part in searching a 100-square-mile area.
On February 15, 2008, a passerby returning from a lunch break discovered a body in a ditch near a Reno business park, identifiable by distinctive bright orange socks. Reno police confirmed the following day, after autopsy, that the body was Brianna Denison. An item of underwear not belonging to Denison, along with DNA of the perpetrator and an unknown female, was found near her body; police suggested it may have been left to taunt investigators and sought help identifying its owner.
On November 12, 2008, James Michael Biela, 27, of Sparks, Nevada, was arrested at a Reno child care center and booked on charges of murder, first-degree kidnapping, and sexual assault. The arrest followed a tip on November 1, 2008, through the Secret Witness program from a friend of Biela's girlfriend, who had found unfamiliar underwear in his truck. Biela denied involvement and declined to give a DNA sample, but police obtained DNA from his young son, which indicated a direct relative had left DNA at both crime scenes. A subsequent warrant led to DNA testing that matched Biela to the Denison case and another rape.
On May 27, 2010, a jury convicted Biela of murder, kidnapping, and sexual assault after about nine hours of deliberation, and he was sentenced to death. On July 30, 2010, he received four additional life sentences for rape and kidnapping in attacks on two other victims preceding Denison's murder. His appeals, including a 2012 habeas corpus petition, have been denied, most recently by the Nevada Supreme Court on June 12, 2019.
The case prompted heightened local gun and self-defense product sales, a public vigil on February 23, 2008, extensive national media coverage, and the passage of Nevada's "Brianna's Law," requiring DNA samples from felony arrestees.
