Murder of Garry Newlove

SOLVED2007Station Road North, Padgate, Warrington, Cheshire, UK3 SOURCESUPDATED JUL 2026
Illustrative

Garry Newlove was born in Salford on 5 November 1959 and was the youngest of three children of Thomas Edward Newlove and Ellen Newlove. He married Helen Marston in 1986, and the couple had three daughters born between 1989 and 1994. Newlove was diagnosed with stomach cancer in August 1992 and recovered following surgery to remove his stomach and spleen. By 2007 he lived in the Padgate area of Warrington, Cheshire, and worked as a sales manager for a local plastics company.

On the evening of 10 August 2007, Newlove was attacked outside his home on Station Road North in Padgate after going outside to confront a group of youths he suspected of vandalising his wife's car. He died in hospital in the early hours of 12 August 2007, less than 36 hours after the attack. The killing followed a longstanding pattern of anti-social behaviour by youth gangs in the Padgate area that had begun several years earlier.

Nine suspects were arrested shortly after the attack. Three individuals were charged with murder on 14 August 2007 and remanded in custody; a fourth was charged and remanded the following day, and a fifth was charged and remanded on 13 September 2007. Adam Swellings, aged 19 and from Crewe, stood trial at Chester Crown Court from 14 November 2007 alongside two 17-year-olds, a 16-year-old and a 15-year-old, the latter four unable to be named for legal reasons.

On 16 January 2008, Adam Swellings, Stephen Sorton (17) and Jordan Cunliffe (16) were convicted of Garry Newlove's murder. Two other defendants were cleared of involvement and released. The three convicted men were sentenced to life imprisonment on 11 February 2008, with the trial judge recommending minimum terms of 17 years for Swellings, 15 years for Sorton and 12 years for Cunliffe; these terms were described as lenient by the victim's family, friends and tabloid media, since they meant the youngest of the three could be released by age 28.

The case became one of several high-profile British killings in the late 2000s associated with youth gang crime, alongside the killings of Tom ap Rhys Pryce, Sophie Lancaster, Rhys Jones, Jimmy Mizen and Ben Kinsella.

Swellings and Sorton appealed their convictions and sentences; the Court of Appeal heard the case on 13 November 2008, upholding Swellings' conviction and sentence while reducing Sorton's minimum term by two years. Cunliffe separately appealed his conviction, arguing he had not taken part in the attack though present, partly citing a degenerative eye condition; this appeal was dismissed on 26 July 2010.

Regarding parole, Cunliffe was recommended for release in December 2019 but was denied in May 2020 after reports of an alcohol-fuelled party in prison; he was eventually paroled in September 2020, a decision unsuccessfully challenged by the Secretary of State. Sorton was recommended for release in February 2020 and is believed to have been paroled the following month. In April 2022, a recommendation to move Swellings to an open prison was blocked by the Justice Secretary.

Garry Newlove's widow, Helen Newlove, campaigned publicly for victims' support and stronger sentencing, was made a life peer in 2010, and later served as interim Victims' Commissioner for England and Wales from October 2023.
