Killing of Shamim Reza Rubel

Shamim Reza Rubel was a BBA student at Independent University, Bangladesh. On 23 July 1998, members of the Detective Branch took him from his home in Siddeswari, Dhaka, and accused him of possessing illegal weapons. No weapons were recovered. Rubel was beaten in custody and died at the Detective Branch office; an autopsy attributed his death to haemorrhage and shock caused by severe beating.
Rubel’s death became a catalyst for legal challenges to arbitrary arrest and custodial abuse. In 2003, the High Court issued safeguards governing arrests without warrant under section 54 and remand under section 167 of Bangladesh’s Code of Criminal Procedure. In 2016, the Supreme Court upheld the core ruling with modifications.
Rubel’s father filed a criminal case against 14 people, including Detective Branch officers and a neighbour. A trial court sentenced 13 defendants to life imprisonment and one defendant to one year. On appeal, the High Court acquitted all but former sub-inspector Hayatul Islam Thakur, whose life sentence remained in place. In 2017, the Supreme Court upheld former assistant commissioner Akram Hossain’s acquittal and dismissed Hayatul’s appeal, leaving his life sentence intact.
