Killing of José and Kitty Menendez

Background

José Enrique Menendez, a Cuban-born entertainment executive, and Mary Louise "Kitty" Menendez married in 1963. Their sons, Joseph Lyle Menendez (born 1968) and Erik Galen Menendez (born 1970), grew up in New Jersey before the family relocated to Southern California when José became CEO of Live Entertainment. In 1988, Lyle and Erik committed a series of neighborhood burglaries; the family subsequently moved to Beverly Hills.

The Killings

On August 20, 1989, José and Kitty Menendez were shot to death in the den of their Beverly Hills mansion while watching a film. José was shot six times and Kitty ten times; Lyle reloaded his shotgun mid-attack to fire a final shot at his mother as she attempted to crawl away. Investigators and forensic staff described the scene as extremely violent. In the immediate aftermath, Lyle and Erik disposed of their clothing and the shotguns, attempted to establish a false alibi at a movie theater, and later called 9-1-1 to report discovering the bodies, falsely claiming they had been elsewhere at the time.

Investigation and Arrest

Detectives initially pursued Lyle's suggestion of a mob-related killing tied to José's business dealings. Suspicion shifted to the brothers after they spent large sums of money on luxury goods and travel in the months following the murders, and after it emerged that they had arranged to delete a recently updated version of their father's will from a family computer. Erik eventually confessed to the killings during sessions with his psychologist, Jerome Oziel, who taped the conversations. After Oziel's mistress, Judalon Smyth, informed police of the tapes, Lyle was arrested in March 1990 and Erik surrendered days later.

Trials

The brothers were charged with first-degree murder with special circumstances and conspiracy to murder, making them eligible for the death penalty. At their first trial (1993–1994), the defense argued the killings were committed in self-defense following years of alleged sexual, physical, and emotional abuse by José, enabled by Kitty. Prosecutors argued the abuse allegations were fabricated and that the killings were premeditated and motivated by financial gain and resentment. Both juries deadlocked, resulting in mistrials. At a second trial (1995–1996), with more restricted testimony and no cameras in the courtroom, the brothers were convicted on two counts of first-degree murder with special circumstances and conspiracy to murder, and were sentenced to life in prison without the possibility of parole.

Appeals and Resentencing

The brothers' convictions were upheld on direct appeal and through subsequent state and federal habeas corpus proceedings, concluding in 2005. In 2023, the brothers filed a new petition citing an allegation that José had sexually abused a former Menudo member and a letter purportedly written by Erik referencing abuse. In October 2024, then-district attorney George Gascón recommended resentencing; his successor, Nathan Hochman, opposed it, calling the brothers' self-defense claims "self-serving lies." In May 2025, a judge resentenced the brothers to fifty years to life, making them parole-eligible because they were under 26 at the time of the killings. In August 2025, the California Board of Parole Hearings denied parole to both brothers, citing rule violations in prison; they are eligible for another hearing in 2028.
