Murder of Falah Zaggam

On the night of 11 May 2004, 17-year-old Falah Zaggam, a private in the Iraqi National Guard, was killed at a military base in Ad-Dawr, Saladin Governorate, Iraq. Zaggam had been paired with 21-year-old Federico Daniel Merida, a U.S. Army National Guardsman with the 30th Brigade Combat Team, for guard duty in a lookout tower. According to accounts later given in the case, Merida and Zaggam had a sexual encounter in the tower, after which Merida shot Zaggam eleven times with his M4 carbine and threw his body off the tower. Following the killing, U.S. and Iraqi soldiers were barred from working alone together in pairs at the base.
Merida initially told investigators he acted in self-defense, claiming Zaggam had tried to rob him. As military investigators continued questioning him, he changed his account, stating that Zaggam had blackmailed him by threatening to reveal the sexual encounter to his wife and superiors, and that he killed him in a rage. He later said Zaggam had not done anything to provoke him and that he had simply flown into a rage after the encounter.
Merida was charged with premeditated murder, making false official statements, and dereliction of duty. He reached a plea agreement with military prosecutors, pleading guilty to unpremeditated murder and two counts of making false official statements before a military court at Forward Operating Base Danger; the agreement capped his maximum sentence at 25 years. He was acquitted of the dereliction of duty charge.
At his September 2005 sentencing hearing, a psychiatrist testified that the killing was likely triggered by a burst of rage connected to sexual abuse Merida had suffered as a child. Merida apologized to Zaggam's family in court. Zaggam's family disputed that Merida acted in self-defense, noting that the first bullet had struck Zaggam's palm — indicating his hand had been raised against the gun muzzle — and that a second bullet had entered his back. They also disputed that the sexual encounter was consensual, alleging Merida had attempted to rape Zaggam and killed him when he resisted; the defense presented medical evidence it said showed the encounter was consensual.
Merida was sentenced to 25 years, the maximum allowed under his plea deal, and was reduced in rank to private and dishonorably discharged. At the time, this was reported as the harshest sentence given to any U.S. service member convicted of a crime committed during the invasion of Iraq. Zaggam's family criticized the military's handling of the case, saying they were initially misled about the circumstances of his death and received $2,200 in compensation, which they said did not cover his funeral costs. Merida was incarcerated at the United States Disciplinary Barracks before being transferred to a civilian federal prison, and was paroled on 31 May 2019.
