Matthew Wayne Shepard was a 21-year-old student at the University of Wyoming when he was attacked near Laramie, Wyoming, in October 1998. Openly gay, Shepard became one of the most widely recognized victims of anti-gay violence in the United States, and his death helped shape a decade of debate over hate-crime law.
On the night of October 6, 1998, Shepard was at the Fireside Lounge, a bar in Laramie, when he was approached by two local men of about his own age, Aaron McKinney and Russell Henderson. The two offered him a ride, then drove him to a remote area east of the city. There they robbed him, beat him, and left him tied to a fence in near-freezing temperatures. He was discovered the following day by a passing cyclist, who at first mistook him for a scarecrow.
Shepard had suffered fractures to his skull and severe damage to his brainstem, injuries doctors judged too extensive to treat surgically. He was taken to a hospital in Fort Collins, Colorado, where he remained unconscious until he died in the early hours of October 12, 1998.
McKinney and Henderson were arrested within days. They were initially charged with attempted murder, kidnapping, and aggravated robbery; after Shepard died, the murder charges were elevated to first-degree murder, which carried the possibility of the death penalty. Their girlfriends were charged as accessories after the fact.
Henderson resolved his case first, pleading guilty in April 1999 to felony murder and kidnapping in exchange for two consecutive life sentences and the removal of the death penalty as an option. McKinney went to trial that autumn. His defense sought to argue that a sexual advance had provoked the attack, a strategy the trial judge did not permit. A jury convicted him of felony murder, kidnapping, and aggravated robbery. Before the sentencing phase could proceed to a possible death sentence, McKinney agreed to two consecutive life terms without the possibility of parole, an arrangement supported by Shepard's parents.
Because Wyoming had no hate-crime statute at the time, neither man was charged under such a law, and the case was prosecuted as murder, kidnapping, and robbery. The attack nonetheless became a focal point of national attention to violence motivated by sexual orientation. In a later recorded interview, McKinney acknowledged hostility toward gay men at the time of the crime.
Shepard's death prompted widespread public response, memorials, and activism, and it was frequently cited during years of legislative debate. In 2009, Congress passed the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act, which extended federal hate-crime protections to offenses committed because of a victim's sexual orientation or gender identity. Both McKinney and Henderson remain incarcerated, serving their life sentences. The case is considered solved, with both perpetrators convicted.
